Common questions about UK settlement

Answers based on current UKVI published rules.

Most visa routes require 5 continuous years of lawful residence in the UK before you can apply for Indefinite Leave to Remain (ILR). Some routes, such as Global Talent (accelerated) or Tier 1 Investor (£10m), qualify in as little as 2–3 years. The 10-year long residence route applies if you have been in the UK lawfully for 10 continuous years on any combination of visas.

You can apply for British citizenship (naturalisation) 12 months after receiving ILR, provided you meet the residency requirements. You must not have spent more than 90 days outside the UK in the 12 months before your application, and no more than 450 days in the 5 years before applying.

If you enter the UK more than 180 days after your visa was granted, your qualifying period starts from the date you actually entered, not the visa grant date. This can delay your ILR eligibility. Our calculator accounts for this automatically when you provide both dates.

Yes. Most visa routes require that you have not spent more than 180 days outside the UK in any 12-month period during your qualifying period. Exceeding this limit can reset your qualifying period or lead to a refusal. Tracking your absences carefully, across every year of your residency, is the only way to stay certain. Immi does this for you automatically.

You can submit your ILR application up to 28 days before your qualifying period ends. Applying earlier than that will result in a refusal. The dates shown by our calculator reflect the earliest date your qualifying period is complete.

Standard ILR processing takes around 8 weeks from submission. However, it can take up to 6 months in some cases. A priority service is available for an additional fee, which aims to process applications within 5 working days. Super-priority (next working day) is also available at some application centres.
